Brian Gaddy has extensive experience in the areas of criminal trial and appellate practice. Gaddy's practice has emphasized white collar criminal matters at the investigatory, trial, and appellate stages. He also has represented clients charged with felony crimes of violence, narcotics offenses, and weapons offenses. Gaddy was appointed in 2004 by the United States District Court for the Western District of Missouri to represent a defendant in a federal capital murder prosecution, where the defense successfully avoided the death penalty.
Gaddy's white-collar criminal experience has included the representation of businesses and individuals in internal investigations, grand jury and agency investigations, complex trial and appellate work, and corporate compliance matters. He has been involved in cases involving allegations of fraud and embezzlement, money laundering, health care fraud, environmental crimes, securities fraud, food and drug violations, banking crimes, public corruption and bribery, RICO offenses, computer and Internet related crimes, telecommunications matters, and corporate fraud and abuse. Gaddy also has represented businesses and individuals in numerous appeals before the federal and Missouri appellate courts. Gaddy has been involved in several cases before the United States Supreme Court. He served as the primary author of a successful petition for a writ of certiorari before the Supreme Court, and he also co-wrote an amicus brief filed in the Supreme Court on behalf of the National Association of Criminal Defense Laywers. He has been involved in postconviction and habeas corpus proceedings at the state and federal levels.
Gaddy also has represented businesses and individuals in related civil litigation and administrative proceedings. He has represented clients before state and federal licensing boards and regulatory agencies. He also has experience in complex commercial litigation matters, including allegations of theft of trade secrets, civil RICO, False Claims Act violations, consumer protection matters, and unfair competition.
Gaddy is a 1994 graduate, with distinction, from the UMKC School of Law. He served as a technical editor on the UMKC Law Review. He received the American Jurisprudence Awards for Criminal Law and Criminal Procedure II and the Ralph S. Latshaw Award for Outstanding Student in Criminal Law Courses. He received a Bachelor's of Science Degree in Accounting from the University of Missouri-Columbia in 1990.
Gaddy has emphasized community and public service throughout his career. He served for seven years as an Adjunct Professor of Law at the UMKC School of Law. He has authored numerous legal articles and materials and has lectured extensively on criminal law topics. Gaddy also has participated in various bar activities, serving as the Chair of the Criminal Law Committee for the Kansas City Metropolitan Bar Association. In 2004, Gaddy was selected to serve on the Merit Selection Panel regarding the reappointment of a United States Magistrate Judge in the Western District of Missouri. Gaddy was selected to serve on the Federal Practice Committee for the United States District Court for the Western District of Missouri. Gaddy has attended the Missouri Bar Trial Institute and the Western Trial Advocacy Institute in Laramie, Wyoming. He is a member of the Kansas City Metropolitan Bar Association, the American Bar Association, the National Association of Criminal Defense Lawyers, and serves on the Board of Directors of the Missouri Association of Criminal Defense Lawyers.
